How Gay Men Can Become Parents in Australia

Altruistic surrogacy

The most direct route to a biological child. Commercial surrogacy is illegal everywhere in Australia, and if you live in NSW, Queensland, or the ACT, that ban extends to arrangements overseas too — commercial surrogacy in another country doesn't avoid the offense. Altruistic surrogacy, domestic or international, is legal, but finding a surrogate can take a year or more given Australia's altruistic-only model and advertising restrictions in most states. A post-birth parentage order is required everywhere to become the legal parent.

Co-parenting

Many gay men build families with a lesbian couple or single woman, sharing parenting across households. This is a much cheaper alternative to surrogacy, though — unlike Ontario or BC in Canada — no Australian state lets you formalize parenthood for more than two legal parents through an agreement alone; arrangements involving more than two intended parents get legally complicated fast and need specialist advice.

Adoption

Same-sex couples and single people have been able to adopt in every Australian state and territory since 2018. It's a genuinely realistic path alongside surrogacy and co-parenting, though as in most countries, domestic infant adoption is uncommon compared with adopting an older child from out-of-home care.
