Surrogacy in Australia: Legal Status, Costs & the Overseas Trap

Altruistic surrogacy is legal across Australia, but commercial surrogacy is illegal in every state and territory — and in New South Wales, Queensland, and the ACT, residents can be criminally prosecuted for commercial surrogacy done anywhere in the world, including countries where it's legal. Every state requires a post-birth court process (a parentage order) to transfer legal parenthood from the surrogate to the intended parents — there is no pre-conception route that skips court, unlike some Canadian provinces.
