In Australia, altruistic surrogacy and known donor arrangements are legal in every state and territory, but commercial surrogacy is a criminal offense everywhere — and in New South Wales, Queensland, and the ACT, that law reaches residents even when the arrangement happens overseas. Legal parenthood after surrogacy always requires a post-birth court order: unlike some Canadian provinces, no Australian state lets intended parents become legal parents through a pre-conception agreement alone.

Known donor arrangements

Legal nationwide, but legal parenthood is genuinely uncertain in private, non-clinic arrangements — the 2019 High Court case Masson v Parsons found a sperm donor could be a legal parent under federal law despite a state law presumption that he wasn't.

Anonymous donation

Banned in every state and territory — donor-conceived people can access their donor's identity as adults. Victoria is the exception in scope: since 2015 its register applies retrospectively to every donation ever made there, while most other states only cover post-reform donations.

IVF / IUI

Available nationwide with a federal Medicare rebate — no state-by-state funding patchwork like Canada's. Eligibility was expanded in 2025 to remove restrictions based on relationship status or sexual orientation.

Commercial surrogacy

Illegal in every state and territory. New South Wales, Queensland, and the ACT go further and criminalize their own residents for commercial surrogacy done anywhere, including overseas — NSW's maximum penalty is 2,500 penalty units (currently $275,000) and/or 2 years' imprisonment.

Altruistic surrogacy

Legal in every state and territory, though eligibility to be an intended parent and the surrogate's minimum age still vary by jurisdiction.

Legal parenthood without adoption

No state skips a court process entirely — a post-birth parentage order is required everywhere. It isn't adoption in the traditional sense, but unlike Ontario or British Columbia in Canada, no signed pre-conception agreement alone can make you a legal parent at birth.

Typical costs

Costs vary widely: known donor and co-parenting arrangements are largely legal-fee driven; IVF typically costs AUD $4,500–$6,500 out of pocket per cycle after the federal Medicare rebate, with no limit on funded cycles; altruistic surrogacy is the most expensive path, commonly AUD $55,000–$120,000 across the full journey once IVF, legal fees, mandatory counselling, reimbursed surrogate expenses, and the parentage order are included.

Typical timeline

Known donor and co-parenting arrangements can move in under a year once the right person is found and an agreement is signed; IVF often takes more than one cycle; altruistic surrogacy typically spans about two years end to end, including the post-birth parentage order process required in every state.
