Surrogacy in the Netherlands: Legal Status, Costs & the International Route
Commercial surrogacy is illegal in the Netherlands and altruistic surrogacy is only tolerated in narrow, private arrangements, so almost all Dutch intended parents pursuing surrogacy go through an international program — commonly in the US or Canada — and then complete a Dutch court procedure to recognize the foreign birth and secure legal parenthood; a pending bill (Wet kind, draagmoederschap en afstamming) would create a formal domestic framework, but as of mid-2026 it is still awaiting a parliamentary plenary debate and is not yet law.
