Surrogacy in the Netherlands: Legal Status, Costs & the International Route

Commercial surrogacy is illegal in the Netherlands and altruistic surrogacy is only tolerated in narrow, private arrangements, so almost all Dutch intended parents pursuing surrogacy go through an international program — commonly in the US or Canada — and then complete a Dutch court procedure to recognize the foreign birth and secure legal parenthood; a pending bill (Wet kind, draagmoederschap en afstamming) would create a formal domestic framework, but as of mid-2026 it is still awaiting a parliamentary plenary debate and is not yet law.

Legal considerations

For international surrogacy, Dutch courts require a post-birth recognition procedure to establish the intended parent(s) as legal parents of a child born abroad — this is a separate legal step from whatever the surrogacy country itself recognizes at birth.
The Netherlands recognizes a maximum of two legal parents, which matters directly for surrogacy involving more than two intended adults, or a known donor plus a couple.
Until the pending reform passes, there is no dedicated Dutch surrogacy contract law — agreements with an altruistic surrogate are not enforceable in family court the way they would be in a jurisdiction with a formal surrogacy statute.

Costs

International surrogacy is by far the most expensive family-building route: a full US program (surrogate compensation, agency fees, IVF, legal, and medical costs) commonly runs €130,000–€190,000 or more; Canadian programs (altruistic-only, lower surrogate compensation) typically total around €75,000–€90,000. On top of this, Dutch legal fees for the post-birth recognition procedure add a further few thousand euros.

Timeline

Months 1–6: choosing an agency and country, matching with a surrogate, and legal/medical screening.
Months 6–18: IVF, embryo transfer, and pregnancy (assuming a successful transfer on the first attempt — many journeys take longer).
After birth: the Dutch post-birth legal recognition procedure, which commonly adds several more months before parenthood is fully secured at home.
End to end, international surrogacy typically takes two or more years from the first serious step to legal parenthood being fully recognized in the Netherlands.
