Known Donor in the UK: Clinic vs DIY, Legal Parenthood & What to Expect

In the UK, whether a known donor becomes a legal parent depends entirely on the route: at an HFEA-licensed clinic, the donor is not the legal parent, and for a female couple the birth mother's partner becomes the second legal parent via signed consent forms completed before treatment — but via DIY/home insemination, the donor remains the child's legal father by default regardless of any private agreement, with the right to seek contact and the obligation to pay child support.

Key facts

Clinic route (HFEA-licensed): the donor is not a legal parent. For a female couple, the birth mother signs Form WP and her partner signs Form PP before treatment begins — this is what makes the partner, not the donor, the second legal parent from birth.
DIY/home insemination route: none of the HFEA parenthood rules apply. The sperm donor is the child's legal father by default, whatever was privately agreed beforehand, and regardless of whether he intended a purely 'donor' role.
If a DIY donor is the legal father, he can apply for contact or parental responsibility, and can also be pursued for child support through the Child Maintenance Service — a known and serious risk of the DIY route that a private agreement cannot override.
A licensed donor's sperm or eggs can be used to create children in up to 10 families under HFEA rules (with no limit on the number of children within one family).

A written donor or co-parenting agreement — not legally binding in itself in family court, but persuasive evidence of everyone's intentions — is standard practice regardless of route. Drafting one with independent legal advice on both sides typically costs £1,000–£3,000+VAT.
Family courts can and do look beyond a private agreement's label when disputes arise — a "donor" who has behaved like an involved parent may later be treated as more than a donor for contact purposes, so intentions need to be reflected consistently in both the agreement and actual conduct.
